General Terms and Conditions of MACERA GmbH and for the use of the website www.macera.ch

Applicability of the Terms and Conditions

These General Terms and Conditions (GTC) apply to all deliveries, services, and offers of MACERA GmbH, unless expressly agreed otherwise in writing. Deviating conditions of the customers are only valid if they have been confirmed in writing by MACERA.

Offer and Conclusion of Contract

The products and configuration options presented in the online shop do not constitute a legally binding offer, but rather an invitation to make an offer. By completing the order process, the customer submits a binding offer to purchase.

A contract is only concluded when MACERA expressly confirms the order by e-mail or begins manufacturing the product. If an order cannot be fulfilled (e.g. due to delivery obstacles or obvious pricing errors), MACERA will inform the customer(s) as quickly as possible.

Products and Configuration

MACERA offers tables with extensive configuration options (type of wood, size, finish, leg color, etc.). Each table is custom-made according to the customer's wishes. Minor deviations in color, structure, or dimensions (within standard commercial tolerances) are due to material and production and do not constitute a defect.

Wood is a natural product, and that is precisely what defines its character. Color differences, knot holes, fine cracks, growth characteristics, or varying grain patterns are not defects but natural properties that make each table unique. These characteristics do not constitute grounds for complaint.

The product images in the online shop are for illustration purposes. Due to different screen settings and the natural properties of wood as a material, colors, grain patterns, and surfaces may differ from the actual product.

Prices

All prices are quoted in Swiss Francs (CHF) and include statutory VAT. Prices and errors are subject to change. Shipping and assembly services are included in the price unless otherwise stated.

Payment

Payment is made using the payment methods listed on the website, unless otherwise agreed.

Purchase on account with partial payment option (POWERPAY)

Upon conclusion of the purchase agreement, our financing partner POWERPAY will take over the resulting invoice claim and handle the corresponding payment modalities. When purchasing on account, you also accept POWERPAY's terms and conditions in addition to ours. (www.powerpay.ch/de/agb).

Delivery and Installation

Delivery is exclusively within Switzerland. The delivery period is usually 8–12 weeks from receipt of order. This period is not binding; customers will be notified in case of delays. Delivery delays do not entitle customers to withdraw from the contract or to claim damages, unless there is intentional or grossly negligent conduct on the part of MACERA GmbH.

Delivery and assembly are standardly carried out in the customer's desired room. Customers are responsible for ensuring that the delivery location is accessible and that the transport routes (especially stairwells, doors, elevators, passages, and corners) are sufficiently dimensioned so that the configured table can be brought in. We recommend checking the spatial conditions before ordering.

If delivery cannot be carried out in the normal way due to local conditions, we will examine the use of a furniture lift. The costs incurred for this will be borne by the customers and will be discussed with them in advance.

If it is not possible to bring the table into the desired room even with a furniture lift, customers will designate an alternative delivery location accessible to our transport partner (e.g., ground floor, house entrance, or garage) to which the table will be delivered. Further transport to the desired location is then the responsibility of the customers. Since it is a custom-made product, returns or refunds are excluded, and the payment obligation remains. The incurred delivery, furniture lift, return transport, and storage costs are borne by the customers.

If no one is present or reachable on an agreed delivery date, a second delivery attempt will be charged separately. Address changes are no longer possible after the delivery date has been agreed upon.

Inspection and Acceptance

Customers are obliged to inspect the delivered product immediately after assembly. Complaints must be reported in writing (by email) within 48 hours. These must be documented with photos. After this period, the service is considered approved.

Retention of title

Goods remain the property of MACERA GmbH until full payment has been received.

Returns and Right of Withdrawal

As all products are custom-made to customer specifications, there is no legal right of return or withdrawal. Cancellation after production has started is excluded. In the event of production defects or transport damage, MACERA undertakes to provide a replacement delivery or remedy the defects. Warranty and Liability

Our tables are manufactured with the utmost care. However, should there be a production defect, it can be reported in writing with photo documentation within 48 hours of delivery. Later complaints will not be considered. Damage caused by improper use, normal wear and tear, or external influences is excluded from the warranty. To the extent permitted by law, any liability for indirect damages, consequential damages, and loss of profit is excluded.

Care

Please observe the care instructions on our website. Damage resulting from improper care, excessive moisture, exposure to heat, or unsuitable cleaning agents is excluded from the warranty.

Product Changes

MACERA reserves the right to make technical changes to product design and minor deviations within reasonable limits, especially if these serve to improve quality.

Force majeure

Events of force majeure (e.g. natural disasters, pandemics, strikes, official orders or supply bottlenecks at suppliers) shall extend delivery periods appropriately. Claims for damages are excluded.

Data protection

MACERA processes personal data exclusively within the framework of Swiss legal data protection regulations. Further details are governed by the separate Privacy Policy.

Copyright

All content, designs, texts, and images displayed on the website are protected by copyright. Any use, reproduction, or distribution is only permitted with the written consent of MACERA GmbH.

Severability clause

Should any provision of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.

Changes to the Terms and Conditions

MACERA reserves the right to amend these General Terms and Conditions at any time. The version valid at the time of the order shall apply.

Jurisdiction and Applicable Law

The relationship between you and MACERA GMBH is in all cases governed by Swiss law in accordance with the provisions of the Swiss Code of Obligations (OR) and the Swiss Civil Code (ZGB). The place of jurisdiction is the registered office of MACERA GmbH in St. Gallen. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
